The Supreme Court will define this notion in June in Heller v. Washington D.C.
Can you define a militia and can you be a member of a militia without signing any document?
The militia of the United States consists of all able-bodied males at least 17 years of age and, except as provided in section 313 of title 32, under 45 years of age who are, or who have made a declaration of intention to become, citizens of the United States and of female citizens of the United States who are members of the National Guard.
The classes of the militia are—
(1) the organized militia, which consists of the National Guard and the Naval Militia; and
(2) the unorganized militia, which consists of the members of the militia who are not members of the National Guard or the Naval Militia.
So, yes, a person can be a member of the militia without signing any document. In fact, most members of the militia are likely unaware of their own membership in the militia.
However, the Supreme Court has side-stepped that issue in Heller v. Washington, D.C., by defining the question at issue not to hinge upon militia membership. Rather, the Court characterizes the question as pertaining to "individuals who are not affiliated with any state-regulated militia."
Reply:Well yes in the original meaning of the word. Pretty much every man with a rifle was considered part of the militia
Reply:Militia - A group of people acting for defensive purposes of a population or territory. If you could find two people that wanted to unite to defend -anything- I would consider them a militia. They don't even need to have weapons. I think some formal means of recognizing them would be in order, such as a uniform, badge, or registry containing the names of its members.
Reply:a militia is a militant volunteer group usually called up in times of dire need, or when a nation first forms it will have militia in place of regular army. in times past there was no documentation needed, but now adays there is usually some paperwork
Reply:Like it or not if you are able bodied and eighteen or older you are in the Militia if you are an American citizen.
That also means like or or not you have to pay for your own rifle, and your own gear. Mustering out pay is them buying it back from you supposedly.
That is what the first two years at reduced pay is all about. What you are doing is paying for your rifle and gear including uniforms.
Now that really peeved me off when I found out that helping a fellow Marine study for his American Citizenship.
Here we were paying the same amount for our rifles and gear that the army was paying (same pay rates) but, we were paying for used wore out junk army had already scraped.
